This visit is the realisation of already expressed intentions and readiness of the two Courts that their Judges, within the framework of professional cooperation, directly exchange the best experiences from their case-law in general and, in particular, in the domain of the rule of law and the protection of human rights and fundamental freedoms.
In this context and within the framework of the agreed program of the working visit, during the two day working meetings, the Judges of the two Courts will present their professional papers, discuss various topics and exchange their views and experiences on the following themes, which they selected as useful and important:
1. Tasks and organization of the Constitutional Court (also from a historical perspective)
2. Case-law of the Constitutional Court on fundamental rights
3. Enforcement of Constitutional Court’s decisions in particular concerning the norm review procedure.
The following members will participate in this visit on behalf of the Constitutional Court of the Republic of Austria: President Prof. Gerhart Holzinger, Vice-President Brigitte Bierlein and Justice Prof. Rudolf Müller and Justice Prof. Georg Lienbacher
The direct bilateral cooperation and exchange of views with the Constitutional Court of the Republic of Austria, which has a long tradition, are of great importance, especially because the establishment of the Constitutional Court of Austria in 1919, i.e. in 1920 is generally considered to have started the tradition of constitutional judiciary in Europe through the institution of constitutional court, as a special constitutional authority.
In this regard, Bosnia and Herzegovina can also boast of having a considerable tradition of constitutional judiciary, which dates back to 1964.
