At the request of President of the Constitutional Court of Bosnia and Herzegovina, Seada Palavrić, Mr. Darko Soldat, Prosecutor of the Department of Economic Crime and Corruption of the Prosecutor's Office of the Canton of Sarajevo held a presentation on the topic of „Digital Evidence between Privacy and Fair Trial“. The presentation was held at the Constitutional Court of Bosnia and Herzegovina on 22 January 2025.
The presentation was organized for lawyers of the Office of the Registrar of the Constitutional Court, working on drafting decisions upon appeals, with a view to improving their knowledge in the field of the use of digital evidence in the judiciary in Bosnia and Herzegovina.
This distinguished expert in the field of digital forensics and cybercrime investigation and doctor of legal sciences presented his experience with digital evidence, stressing that most crimes have some form of appearance in the digital world. He also drew attention to the legal framework for obtaining electronic evidence with special reference to the Budapest Convention on Cybercrime Crime from 2001, including its advantages and disadvantages. He referred to the international and bilateral agreements; to the scope of regulations; to international legal assistance through multilateral and bilateral agreements; to voluntary data disclosure and cooperation with private entities; to the legality of evidence in electronic form; to the legality of encrypted electronic communication; to the right to privacy and the right to a fair trial.
The Constitutional Court expressed its gratitude to Mr. Soldat for his presentation.
