The Conference was attended by the Presidents and Judges of the Constitutional Courts of Bosnia and Herzegovina, Montenegro, Croatia, Macedonia, Slovenia and Serbia and representatives and legal experts from the German Foundation for International Legal Cooperation - IRZ.
International multilateral and bilateral cooperation, international conferences, expert and scientific gatherings represent an opportunity and method in which the constitutional courts, inter alia, may promote their doctrine, experience and practice, particularly in the area of the rule of law, protection and promotion of human rights and fundamental freedoms. In that context, of particular importance is an exchange of experience, views and practices on the application of law, as well as an establishment of a professional cooperation in regards to other issues of common interest and significance for the constitutional courts of the countries in the region in which constitutional justice share common beginnings and grounds.
The Constitutional Court of Bosnia and Herzegovina has raised the initiative for holding gatherings of the constitutional courts of the countries in the region, back in 2003.
The aim of the initiative was to exchange experiences, views and practices on the application of the law in the area of the rule of law, protection and compliance with human rights and fundamental freedom as well as to establish professional cooperation also in regards to other issues of common interest and significance for the constitutional courts of the countries in transition. The initiative was accepted by the constitutional courts of the countries of the region and it has now become a tradition to hold the regional conferences/round tables on various topics of common interest.
The today’s Conference with a number of good-quality presentations/papers on the topic of the Conference and discussions that ensued, has shed a light on the issue of relation of actual and declared independence of the national constitutional courts in the region. The Conference thus represents yet another contribution to the position, legal practice and doctrine of the constitutional courts of the region.
The Conference was dived into four working units. The content and course of the work was moderated by the President of the Constitutional Court of Bosnia and Herzegovina, Mirsad Ćeman, Vice-President of the Constitutional Court of Bosnia and Herzegovina Mato Tadić and Head of the Department of IRZ for Bosnia and Herzegovina, Montenegro, Macedonia and Serbia, Dr. Stefan Pürner. In fact, nine very successful and significant papers were presented that covered almost all aspects of the topic of the Conference.
All papers presented at the Conference will be published in the Conference Proceedings.
