On 15 February 2024, the Constitutional Court of Bosnia and Herzegovina held its 141st plenary session. The session was held electronically.
The Constitutional Court considered a large number of appeals related to violations of the right to a fair trial within a reasonable time. In this respect, the Court adopted several decisions in which the right to a trial within a reasonable time before the courts of the Federation of Bosnia and Herzegovina was found to be violated. In these decisions, the Constitutional Court reiterated that in a number of its decisions it had already established a violation of the right to a trial within a reasonable time on issues similar to those raised in these decisions. It also reiterated its established case law indicating the existence of a system issue regarding the deciding the cases within a reasonable time before the courts in Bosnia and Herzegovina. This is a consequence of system deficiencies in the organization of the judiciary and the effective exercise of the competences of various levels of public authorities in this area.
The Constitutional Court also adopted a number of decisions rejecting appeals based on Article 18 of the Rules of the Constitutional Court, which stipulates various grounds for inadmissibility of appeals.
All decisions adopted at today's plenary session will be delivered to the applicants/appellants within one month. It will published as soon as possible on the website of the Constitutional Court of Bosnia and Herzegovina.
