Constitutional Court of Bosnia and Herzegovina held today its 106th plenary session.
Constitutional Court of BiH decided on a number of requests for review of constitutionality of laws and appeals on alleged human rights and fundamental freedoms violations.
For the illustration purposes we note the following:
Deciding in case no. U 4/17, the Constitutional Court of BiH rejected as inadmissible a request of 11 members of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina for review of the constitutionality of the Law Amending the Law on Higher Education of the Tuzla Canton as the Constitutional Court of Bosnia and Herzegovina is not competent to take a decision.
As the request was rejected as inadmissible, the Constitutional Court has not considered separately the applicant’s request for an interim measure.
Deciding in the case no. U 5/17, the Constitutional Court of Bosnia and Herzegovina rejected as inadmissible the request of thirty eight representatives of the National Assembly of the Republika Srpska for the review of constitutionality and legality of the Rulebook on Licensing and Driver Qualification Card Requirements due to the lack of jurisdiction of the Constitutional Court of Bosnia and Herzegovina.
Deciding in case no. U 6/17, the Constitutional Court of Bosnia and Herzegovina dismissed the request of twenty six representatives to the House of Representatives of the Parliament of the Federation of Bosnia and Herzegovina for the review of constitutionality of Article 3.15 of the Election Law of Bosnia and Herzegovina, as it established that Article 3.15 of the Election Law of Bosnia and Herzegovina is in conformity with Articles I(2), II(1), II(2), II(3), II(4) and II(5) of the Constitution of Bosnia and Herzegovina, Articles 14 and 17 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, Articles 25 and 26 of International Covenant on Civil and Political Rights, Article 3 of Protocol No. 1 and Article 1 of Protocol No. 12 to the European Convention for the Protection of Human Rights and Fundamental Freedoms and Article 1 of the International Convention on the Elimination of All Forms of Racial Discrimination.
All decisions taken at the session are to be delivered to the appellants within one month time-limit and posted on the official website of the Constitutional Court of Bosnia and Herzegovina.
