In reference to recent frequent media statements concerning the work of the Constitutional Court of Bosnia and Herzegovina, we would like to stress the fact that the Constitutional Court of Bosnia and Herzegovina is founded under Article VI of the Constitution of Bosnia and Herzegovina as an independent guardian of the Constitution of Bosnia and Herzegovina and institutional guarantor of the protection of human rights and fundamental freedoms as established by the Constitution of Bosnia and Herzegovina and instruments under Annex I to the Constitution.
Within such constitutional responsibilities, the Constitutional Court of Bosnia and Herzegovina decides the cases independently and in accordance with its Rules.
When adopting its decisions, the Constitutional Court of Bosnia and Herzegovina is not subject to any or anyone’s outside influences and would like to stress that any such possible attempt would indeed represent an attack on the independent position of the Constitutional Court of Bosnia and Herzegovina and result in a violation of the fundamental constitutional principle of the rule of law under Article I(2) of the Constitution of Bosnia and Hercegovina which is a foundation for Bosnia and Herzegovina as the democratic state.
