The Constitutional Court of Bosnia and Herzegovina held its 89th ordinary session of the Grand Chamber today, 22 May 2019.
Out of the decisions adopted today, the Constitutional Court highlights the following one.
AP-951/17 - in this decision, the Constitutional Court found a violation of the appellant’s right to a fair trial under Article II (3) (e) of the Constitution of Bosnia and Herzegovina and Article 6 (1) of the European Convention for the Protection of Human Rights and Fundamental Freedoms. The Constitutional Court found that the proceedings were not fair wherein the circumstances of the relevant case reveal the manifest arbitrariness in the manner in which the Supreme Court of the Federation of BiH interpreted the relevant provisions of Article 103 (3) of the F BiH Labour Law with regard to the deadline for filing a complaint, and Article 19 (4) of the F BiH Labour Law, which provides that a fixed-term employment contract is automatically converted into the employment contract of indefinite duration after two years of continuous employment or after more than two years of employment with the same employer.
All decisions taken at the session are to be delivered to the appellants within one month time-limit and posted on the official website of the Constitutional Court of Bosnia and Herzegovina as soon as possible.
