The Constitutional Court of Bosnia and Herzegovina has held today the 149th ordinary session of its Grand Chamber.
Of decisions it adopted today, the Constitutional Court has singled out the following:
AP 4279/20 – The Constitutional Court found a violation of the appellant’s right to a fair trial as the disputed proceedings lasted longer than 16 years. Out of that period, the proceedings before the Cantonal Court took nine years. The Cantonal Court has failed to give reasons that would justify such lengthy proceedings that could then lead to a different conclusion.
AP 835/21 – The Constitutional Court found a violation of the adoption of decision within a reasonable time limit when the criminal proceedings against the appellant in the relevant period lasted longer than 12 years.
AP 1312/22 – The Constitutional Court found that in the instant case, the fact that the appellant's request to replace prison sentence with a fine was dismissed, has caused the violation of the appellant’s right to no punishment without law.
All decisions adopted at today’s session are delivered to the appellants within one month and posted, as soon as possible, on the website of the Constitutional Court of Bosnia and Herzegovina.
