The Constitutional Court of Bosnia and Herzegovina at its 109th plenary session held a preliminary deliberation on a request for review of constitutionality of the law, examined enforcement of several of its decision, decided on a number of appeals on alleged violations of human rights and fundamental freedoms and examined the Report on the Work and Report on Budget Execution of the Constitutional Court of BiH for 2017.
For the illustration purposes, we note the following:
In case no. U 4/18, the Constitutional Court held a preliminary deliberation on the request of Borjana Krišto, Chair of the House of Representatives of the Parliamentary Assembly of BiH for review of the constitutionality of the provision of Article IV.A.2.8., paragraph 3, of the Constitution of the Federation of Bosnia and Herzegovina. The applicant is of the opinion that the challenged provision of the Constitution of F BiH is in contravention of Article I(2) of the Constitution of Bosnia and Herzegovina, Article 3 of Protocol No. 1 to the European Convention for the Protection of Human Rights and Fundamental Freedoms and Article II(4) of the Constitution of BiH in conjunction with Article 25 of the International Covenant on Civil and Political Rights (1996) and Optional Protocols (1996 and 1989).
The Constitutional Court will adopt decision in this case at one of the following plenary sessions. The Constitutional Court will invite the High Representative for Bosnia and Herzegovina to offer its written observations on this issue as amicus curiae.
The Constitutional Court postponed decision-making in cases concerning the enforcement of its decisions nos. U 5/16, U 6/16, U 20/16, U 21/16 and U 2/17.
All decisions on the requests for review of constitutionality and appeals adopted at the session will be delivered to the applicants within one month and available at the website of the Constitutional Court of Bosnia and Herzegovina.
