The Constitutional Court of Bosnia and Herzegovina held today its 101st regular session of the Grand Chamber of the Constitutional Court of Bosnia and Herzegovina.
Of the decisions adopted today, the Constitutional Court singles out the following:
AP 1080/18 - The Constitutional Court concluded that there is a violation of the appellant’s constitutional right to a fair trial under Article II(3)(e) of the Constitution of Bosnia and Herzegovina. The violation occurred as the regular court has failed to examine an important question whether the case involves a state property for the purpose of the Law on Temporary Prohibition of Disposal of State Property of Bosnia and Herzegovina. It has also arbitrarily applied a substantive law finding that the Law on Real Property of the Federation of BiH as lex posterior derogates the Law on Temporary Prohibition of Disposal of State Property of Bosnia and Herzegovina.
All decisions taken at the session are to be delivered to the appellants within one-month time-limit and posted on the official website of the Constitutional Court of Bosnia and Herzegovina as earliest as possible.
